Legal agreement governing your use of ACT websites, donation platform, and scholarship services

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING ANY ACT PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Arizona Christian Tuition ("ACT"), a 501(c)(3) nonprofit and Arizona-certified School Tuition Organization. These Terms govern your use of actsto.org, arizonachristiantuition.com, and my.actsto.org (the "Platform"). By registering, donating, creating a campaign, or otherwise using the Platform, you agree to these Terms.

2. Description of Services

  • Donor services:individuals and businesses may donate to student campaigns or ACT's general scholarship fund.
  • Campaign services: parents and guardians may create and manage student scholarship campaigns.
  • Scholarship administration: ACT awards tuition scholarships to qualifying Arizona students under A.R.S. § 43-1089.
  • Tax credit documentation: ACT issues donor acknowledgment letters and annual tax credit records.
  • Communication services: ACT provides updates via SMS, email, voice, and in-app notifications per the ACT Communication Policy.

3. User Accounts

  • You must provide accurate, current, and complete information when registering.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Notify ACT immediately of any unauthorized account access at hello@actsto.org.
  • Each individual may hold only one personal account. Each organization may hold one account with a designated Authorized Representative.
  • ACT may require identity verification for campaign creation, scholarship applications, or large transactions.

4. User Responsibilities by Role

4.1 Parents and Legal Guardians

  • You represent you are the legal parent or guardian of the student identified in any campaign.
  • All student information submitted (name, grade, school) must be accurate.
  • Donated funds must be used solely for qualifying Arizona private school tuition and fees.
  • You are responsible for the accuracy and appropriateness of all campaign content including images and videos.

4.2 Individual Donors

  • Donations are contributions to ACT as a 501(c)(3) nonprofit, not direct payments to individuals or families.
  • ACT retains full discretion over scholarship awards regardless of campaign designation.
  • Annual donation limits apply under A.R.S. § 43-1089 and are set each year by the Arizona Department of Revenue.
  • Donations are generally non-refundable once processed (see Section 7).

4.3 Business and Corporate Donors

  • Corporate donations may qualify for the Arizona Corporate Tax Credit under A.R.S. § 43-1183 and § 43-1184, subject to pre-approval from the Arizona Department of Revenue.
  • The Authorized Representative submitting a donation binds the organization to these Terms.
  • Once a business has determined the amount of the corporate tax credit they would like to donate, ACT submits the donation pledge to the Arizona Department of Revenue (ADOR) to ensure it fits within the statewide cap.
  • The process starts July 1; prompt application is necessary before the annual cap is reached.
  • Make the Donation: Once approved, the business must make the contribution within 20 days.
  • Businesses claim the credit on their Arizona corporate tax return (Form 335).

5. STO Donations and Arizona Law

ACT is certified by the Arizona Department of Revenue as a School Tuition Organization under A.R.S. § 43-1089 through § 43-1089.04 (individual credit) and A.R.S. § 43-1183 through § 43-1184 (corporate credit). The following 2026 tax year donation limits apply (subject to annual adjustment):

  • Single / Head of Household: Original $787 + Overflow $784 = Combined $1,571 maximum.
  • Married Filing Jointly: Original $1,570 + Overflow $1,561 = Combined $3,131 maximum.
  • Corporations: up to 100% of Arizona tax liability; pre-approval from AZ DOR required.

Arizona law requires that STO donations must not be earmarked for a specific student as a condition of receiving the tax credit. Campaign designations express donor preference but are subject to ACT's compliance with Arizona STO statutes.

6. Campaign Content Standards

  • Campaigns must include accurate student first name, grade, school name, truthful narrative, funding goal, and end date (maximum 365 days).
  • Prohibited content: false or misleading information, defamation, harassment, hate speech, full home addresses, government ID numbers, personally identifiable information (PII), unauthorized third-party trademarks, or any content violating Arizona or federal law.
  • Images and videos must be owned or licensed by the uploader. Media depicting minors requires parent/guardian consent.
  • ACT reserves the right to review, edit, decline to publish, or remove any campaign or content that violates these Terms.
  • By uploading media to the Platform, you grant ACT a non-exclusive, royalty-free license to display and use that media in connection with your campaign and ACT's mission-related communications.

7. Payments and Refunds

  • All donations are processed by PayPal, Inc. By donating you agree to PayPal's User Agreement at paypal.com/us/legalhub/useragreement-full.
  • ACT does not store credit card or bank account numbers. Payment data is handled by PayPal under PCI DSS standards.
  • Donations are non-refundable except for: duplicate or erroneous charges caused by a platform error, donations to campaigns removed for Policy violations, or fraudulently obtained donations as determined by ACT.
  • Refund requests must be submitted to hello@actsto.org within 30 days of the transaction with the transaction ID and reason.

8. SMS Terms

By separately opting in to receive SMS communications from Arizona Christian Tuition (ACTSTO), you agree to receive text messages related to your account, donation confirmations, scholarship campaigns, campaign updates, event reminders, program announcements, and support-related communications.

Message frequency varies based on your account activity, donation activity, campaign participation, and communication preferences. Message and data rates may apply. You may opt out at any time by replying STOP to any ACTSTO text message. For help, reply HELP or contact ACTSTO at (602) 421-8301 or hello@actsto.org.

Consent to receive SMS messages is not required to donate, create an account, create a campaign, apply for scholarship support, or use ACTSTO services. SMS consent is collected through a separate optional checkbox or other documented opt-in method. ACTSTO does not sell, rent, or share SMS consent or mobile phone numbers with third parties or affiliates for their own marketing or promotional purposes.

Wireless carriers are not liable for delayed or undelivered messages.

9. Scholarship Awards

  • Students must be Arizona residents enrolled in a qualifying private school under A.R.S. § 43-1089(G).
  • Students may not be family members of an ACT board member or employee.
  • Scholarship awards are limited by available funds and Arizona law. Applying or creating a campaign does not guarantee an award.
  • ACT retains full discretion over scholarship award amounts, timing, and recipients.

10. Prohibited Conduct

  • Using the Platform for any unlawful purpose.
  • Creating fraudulent accounts, campaigns, or transactions.
  • Impersonating any person, organization, or ACT staff member.
  • Attempting unauthorized access to any account, server, or system.
  • Scraping or harvesting data from the Platform without written authorization.
  • Circumventing donation limits, tax credit restrictions, or eligibility requirements.
  • Distributing spam, malware, or unsolicited communications through the Platform.

11. Intellectual Property

All Platform content not submitted by users — including text, logos, graphics, and software — is the property of ACT and protected by U.S. copyright and trademark law. The ACT name and logo (round and horizontal mark) are trademarks of Arizona Christian Tuition. You may not use ACT's trademarks without prior written permission.

12. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. ACT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ACT IS NOT A TAX ADVISOR, FINANCIAL ADVISOR, OR LEGAL ADVISOR. INFORMATION ON THE PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY. CONSULT A QUALIFIED TAX PROFESSIONAL REGARDING YOUR SPECIFIC CIRCUMSTANCES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. ACT'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL DONATIONS PROCESSED THROUGH YOUR ACCOUNT IN THE PRIOR 12 MONTHS, OR (B) $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless ACT, its officers, directors, employees, and volunteers from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or content you submit.

15. Dispute Resolution

  • Before filing legal action, contact hello@actsto.org to attempt informal resolution. ACT will respond within 30 days.
  • Unresolved disputes shall be resolved by binding arbitration under AAA Consumer Arbitration Rules in Maricopa County, Arizona, or by telephone/video.
  • CLASS ACTION WAIVER: You may only bring claims in your individual capacity, not as a class member in any class or representative proceeding.

16. Governing Law

These Terms are governed by the laws of the State of Arizona. Any action not subject to arbitration shall be brought exclusively in the state or federal courts in Maricopa County, Arizona.

17. Termination

ACT may suspend or terminate your account at any time for conduct that violates these Terms, harms other users, violates applicable law, or jeopardizes ACT's 501(c)(3) or STO certification status. Provisions that by their nature should survive termination (including Sections 10–14) will continue to apply.

18. Changes to Terms

ACT may update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance.
